OUR HISTORY: WHERE WE HAVE BEEN; WHERE WE ARE GOING

"Only one who devotes himself to a cause with his whole strength and soul can be a true master. For this reason mastery demands all of a person."

-Albert Einstein

The client's best interest is always our number one priority -- giving all of our clients the most efficient and personalized service we can offer is important to each and every person at Robert M. Montgomery, Jr. & Associates, P.L.

In 1973, Montgomery represented a plaintiff in a medical malpractice case in St. Petersburg, Florida. Montgomery's verdict was in excess of $700,000.00, one of the highest verdicts received at that time. Thus, Montgomery's long, successful career as a plaintiff's lawyer began.

In 1990, Montgomery represented an expectant mother and her young child, whose car was hit broadside by a large steel fabricator truck that had run a red light. The woman lost her unborn child and she suffered a severe brain injury. The case was ultimately settled for $10,000,000.00, the largest settlement in the history of the State of Florida at that time.

In 1991, Mr. Montgomery and his associates made national and international headlines when they represented a young woman, the first known case wherein a dentist infected his patient with the AIDS virus. Montgomery quickly collected the dentist's medical malpractice insurance. Montgomery then used a novel theory, contending that the patient's HMO was negligent. The HMO settled the claim for a very significant amount. Mr. Montgomery and Ms. Larson went on to represent and receive substantial settlements for three other patients who were infected by this same dentist.

In 1995, the State of Florida retained Montgomery as lead counsel, along with other prominent law firms, to represent the State against the tobacco industry. Montgomery sought damages from "Big Tobacco" to reimburse the State of Florida for Medicaid expenses. The State of Florida filed suit against Philip Morris, Brown & Williamson, R.J. Reynolds, and other leading tobacco companies. Montgomery focused his time and energy for the next two years on this monumental case, which resulted in an $13.5 billion settlement for the benefit of the citizens of the State of Florida. This was one of the first victories obtained against the tobacco industry.

In 2001, Montgomery obtained a $225 million confidential settlement in a probate matter.

In late 2002, Mr. Montgomery and the lawyers at his firm successfully sued the distributor of a "Saturday Night Special" handgun that a student used to shoot and kill his schoolteacher. Statistically, the Raven MP.25 handgun that was used was shown to have no legitimate purpose and to be disproportionately used in the commission of crimes. It is our hope that the verdict in this case will result in these guns being removed from the market and eventually from our streets.

Where are we going?
