Settlement reached in first known case where patient infected with AIDS by health-care worker!

December,1991-Represented by Robert Montgomery of West Palm Beach, Kimberly Bergalis, 23, reached a $1 million settlement with CNA Insurance Co., after likely being infected with AIDS by her dentist, Dr. David Acer, in December of 1997. Acer, a bisexual who practiced in Stuart, Fla. before he died, treated about 1,700 patients after contracting AIDS, never telling them he had the disease. On behalf of Bergalis, Montgomery filed suit against CNA, Acer's insurer, alleging that it should have known that Acer had AIDS and barred him from operating before issuing him a $1 million malpractice insurance policy.
