WEST PALM BEACH - A jury awarded $3 million to the husband and two
children of a 38-year-old mother who died during chemotherapy treatments
for leukemia at JFK Medical Center. Attorney Bob Montgomery argued
that a surgeon nicked Kimberly Dawn Kennedy's lung as he inserted
a chest tube to carry the chemotherapy medicines. Kennedy, a dental
hygenist from West Palm Beach, died Oct. 5 2001, eight days after
the catheter was inserted. The circuit court jury, which returned
the verdict April 1, found that the late Dr. John Kearney was 90
percent liable and anesthesiologist Dr. William Caskey was 10 percent
responsible. Five other doctors were found not responsible. The
jury awarded $1.5 million to Bryan Kennedy and $750,000 each to
the two children. Montgomery had asked the jury for a $30 million
verdict.
