When you read the profiles of Robert Montgomery and the attorneys
that practice with him, you will see that they belong to an outstanding

In the controversial Presidential election of 2000, we even represented an officer of the Palm Beach County Board of Elections during the recount process. Personal
Injury and Wrongful Death
Robert M. Montgomery, Jr. & Associates, P.L. represents people injured or killed in
automobile accidents, airline disasters, railroad accidents, industrial
accidents, and other accidents caused by another's negligence.
Notably, though, at the beginning of his law career, Montgomery
was a defense attorney who represented insurance companies. Simply,
he and the attorneys at his firm know how insurance companies
and defense attorneys operate. The firm's lawyers have
won many multi-million dollar verdicts for it's clients.
For example, in 1996, our firm received a $1,600,000.00 verdict for a Bahamian family. They were involved in a serious automobile accident in which they lost their grandmother.
Of course, we also represent many people with lesser injuries and help them receive the best result possible.
Medical
Malpractice
Sometimes people are injured due to the negligence of doctors,
hospitals, and their employees. Medical malpractice is a specialized
area in which Robert M. Montgomery, Jr. & Associates, P.L. has excelled.
In 1994, we represented the family of a 19-month old child who was killed by an overdose of anesthesia. No amount of money could ever replace a child, however, Robert M. Montgomery, Jr. & Associates, P.L. did receive a $9,000,000.00 verdict for these parents to help compensate them for their pain and suffering.
Automobile Accidents
People often think that Robert M. Montgomery, Jr. & Associates, P.L. does not handle automobile accident cases - this is not true! The lawyers at Robert M. Montgomery, Jr. & Associates, P.L. reach settlements or go to trial and obtain verdicts in many automobile negligence cases every year. We apply the same level of determination and legal expertise to auto accidents that we do to the more complex and highly publicized matters that we handle.
Products
Liability
Products can hurt people. Robert Montgomery was the lead attorney
in the lawsuit filed by the State of Florida against American
tobacco manufacturers. The amount of the settlement? $11.3 billion,
which was later increased to $13.5 billion. Since 2000, the firm has been involved in a lawsuit wherein a 13-year
old boy shot and killed his teacher with a small handgun known
as a "Saturday Night Special." Therein suit was filed against
the distributor, seller and owner of the handgun. Settlements
prior to trial totaling almost one million dollars were reached
with the seller and owner of the handgun. In late 2002, the case
against the remaining defendant, gun distributor, went to trial;
at trial, the jury returned a verdict in excess of $24 million.

Contract
and Commercial Litigation
Rebecca Larson assisted the Chairman of the Board of a failed
Savings & Loan Association in successfully defending a shareholder
suit, as well as a suit brought by various banking entities, including
the RTC. Montgomery also successfully tried a partnership dispute
between an attorney-partner and a New York law firm, with a judge
rendering a judgment in the amount of $2,487,502.00. Later, Montgomery
represented two radiology oncologists when a local hospital tried
to terminate their privileges after 17 years of faithful service.
This case ended with a $22,800,000.00 jury verdict in favor of
our clients, the oncologists. (During the appellate process, the
case was ultimately settled and resulted in a multi-million dollar
payment being made to the doctors). Most recently, Montgomery
negotiated a confidential settlement in a probate case that resulted
in $225 million being paid to our client.
Nursing Home
Abuse
Preserving the legal rights of the elderly is one of our most
passionate areas of practice. A nursing home is intended to be
a place where your parent or your grandparent gets the specialized
medical care and personal attention that he/she needs. Unfortunately,
some nursing home facilities don't turn out to be what families
intend; instances of nursing home negligence and/or abuse are
on the rise. Examples of nursing home abuse/neglect include: allowing
pressure sores to develop, failing to provide proper hygienic
care, applying physical restraints unnecessarily, overmedicating
patients, and physically or sexually abusing patients. If you
suspect that you or a relative has been the victim of nursing
home abuse, it is important that you seek help.

Aviation Accident Litigation
From small, single engine, airplane crashes to commercial jetliner
disasters, the lawyers of Robert M. Montgomery, Jr. & Associates, P.L. have litigated a number
of these tragic cases. Having reached settlements in excess of
one million dollars ($1,000,000) in three mid-air collision cases
over the past two years, our attorneys bring particular insight
to these often highly publicized cases. Aviation accident litigation
is a major emphasis within the firm's general tort practice.
Insurance Law
Our lawyers are experts on insurance law, dealing with it on a
daily basis. For example, Mr. Montgomery
made national headlines when he reached a substantial settlement
in the first known case wherein a dentist infected a patient with
the AIDS virus. The settlement was with both the dentist's malpractice
insurance carrier and the patient's health insurance carrier,
who Montgomery said bore responsibility for the patient's relationship
with the dentist.
